The draft Permanent Local Housing Allocation (PLHA) Program Years 3 and 4 Allocation Application including the Reuse Plan, Amendment to the Five-Year Plan, and Year 1 Budget Revision Form, are comprehensive documents that provide a strategy for the use of state funds granted to the Urban County of Orange (County) by California Department of Housing and Community Development (State HCD) under the PLHA Program that provides grants to local governments in California for housing-related projects and programs that assist in addressing the unmet housing needs of their local communities.

The County received the Year 1 PLHA Allocation that has a State HCD internal disbursement deadline of April 30, 2024. The City of Laguna Woods is unable to utilize the Year 1 Allocation of $32,942 for its accessibility modification program. The funds are recommended to be reallocated to the County Emergency Shelter Programs, as reflected in the Year 1 Budget Revision Form. 

The County will receive a Years 3 and 4 Formula Allocation as an entitlement jurisdiction and will provide a proportional share of the allocation received for the unincorporated areas of Orange County and the Urban County cities of  Brea, Cypress, Dana Point, La Palma, Laguna Beach, Laguna Hills, Laguna Woods, Los Alamitos, Stanton, Villa Park and Seal Beach, provided that the Urban County cities meet the PLHA threshold requirements and continue to meet the PLHA requirements during the Five-Year Plan. The information contained in the Draft PLHA Years 3 and 4 Allocation Application including a Reuse Plan and Amendment to the Five-Year PLHA Plan represents eligible PLHA Activities chosen by the Urban County cities and the County for the unincorporated areas.

The Five-Year Plan Amendment includes removing the City of San Juan Capistrano’s funding and activities since the City applied to PLHA on its own and rounding all the activity percentages to whole numbers in Years 3 through 5, per State HCD guidance.

The activities to be allocated funding on behalf of the urban county cities and unincorporated areas focus on two eligible activities. They include: 1) assisting persons who are experiencing or at risk of homelessness, including, but not limited to, providing rapid rehousing, rental assistance, supportive/case management services that allow people to obtain and retain housing, operating and capital costs for navigation centers and emergency shelters, and the new construction, rehabilitation, and preservation of permanent and transitional housing; and 2) accessibility modifications for seniors in their owner-occupied housing units. Both activities target households with income at or below 60 percent of Area Median Income (AMI). 

In addition, the County will use no more than five percent of the PLHA funding for costs related to the administration of activities for which the allocation was made. 

Comments  

The purpose of this notice is to provide the public a minimum 15-day review period to express their concerns and comments. The public comment period begins March 24, 2024 and ends April 8, 2024. All persons either favoring or opposing the PLHA Application including the Reuse Plan, Amendment to the Five-Year Plan, and Year 1 Budget Revision Form are invited to present their views in writing or before the Board of Supervisors.

REQUEST FOR RELEASE OF FUNDS

On or about April 9, 2024, the County of Orange, OC Housing & Community Development (OCHCD), will submit a request to the U.S. Department of Housing and Urban Development (HUD) Office of Public and Indian Housing for the release of 8 Orange County Housing Authority (OCHA) Housing Choice Project-Based Vouchers (PBVs) as authorized under Title I of the Housing Opportunity Through Modernization Act of 2016 (HOTMA), as amended to undertake a project known as The Orion (Development).

The Orion affordable housing community is located on 3.85 acres of land on an H-shaped lot that is currently occupied by the former campus of the Rehabilitation Institute of Southern California. The proposed project includes the demolition of the existing Rehabilitation Institute building and the new construction of 164 units affordable to seniors aged 62 and up earning between 30-70% of the area mean income, with two managers units reserved for employees living onsite. Of the 166 total units, approximately 111 apartments would have a 1-bedroom floor plan and 55 apartments would have a 2 bedroom floor plan, with unit sizes ranging from 547 to 700 square feet. Two of the 2 bedroom units would be reserved as managers units.

USA Properties Fund, Inc. and Riverside Charitable Corporation, the developers, have requested 8 OCHA Housing Choice PBVs under the County of Orange 2023 Supportive Housing Notice of Funding Availability that will serve Mental Health Services Act (MHSA) eligible seniors experiencing homelessness or at-risk of homelessness with rents set at 30% AMI.  

FINDING OF NO SIGNIFICANT IMPACT

The County of Orange, Housing & Community Development has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR). The Development is in the City of Buena Park at 7101 Lincoln Avenue, a property that will be acquired by C&C Development Co., LLC (Developer) from the City of Buena Park. The Development would involve the demolition of the existing commercial building and construction of a new affordable multi-family residential rental project It will consist of 54 affordable/supportive housing units, plus 1 on-site manager’s unit.

The Developer has requested 13 OCHA PBVs (VASH, Mainstream and/or Housing Choice PBVs) under the County of Orange 2023 Supportive Housing Notice of Funding Availability. These 13 PBVs will be guaranteed for 20 years and target individuals earning no more than 30% of the Area Median Income (AMI).

The Development is located in the City of Huntington Beach at 17251 Beach Boulevard. The County acquired the project site consisting of a 64-room motel with Homekey funds and ground leased it to the Developer and it has been operating as interim housing since 2022. The project is an adaptive reuse development that includes the conversion of current motel (former Quality Inn and Suites Motel), operating as interim housing, into approximately 62 permanent supportive housing (PSH) studio units and one manager’s unit.

The Developer, American Family Housing, has requested 62 OCHA PBVs (VASH, Mainstream and/or Housing Choice PBVs). These 62 restricted apartments will be guaranteed for 20 years and target individuals earning no more than 30% of the Area Median Income (AMI).

The OCHCD has determined that the development will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. The Fiscal Year 2024-25 Funding Allocation Policy & Process (FAPP) outlines the proposed funding process and policies for distribution of Federal Community Development Block Grant (CDBG), Emergency Solutions Grant (ESG) and Home Investment Partnerships Program (HOME) funds for housing, economic development, public facilities and improvements, public services, and property rehabilitation activities that benefit low- and moderate-income households.

The percentages of available funds listed in the FAPP are shown as estimated projections. Percentages of available funds will be dedicated to eligible activities that are consistent with the priority needs that will be identified in the Orange County’s FY 2020-24 Consolidated Plan (CP).

Consistent with 24 CFR 91.105, Housing & Community Development (HCD) encourages citizen participation by receiving comments throughout the year and more specifically providing Public Notices and Public Hearings regarding funding for housing and community development activities.

The Development is in the City of Costa Mesa at 1400 Bristol Street, a property that will be acquired by the County of Orange and ground leased to American Family Housing (Developer) or its designee, for 55 years for operations as required under the Homekey program. The Development will consist of 76 units, plus 2 on-site manager’s units.

The Developer has requested 48 OCHA PBVs (VASH, Mainstream and/or Housing Choice PBVs). These 48 PBVs will be guaranteed for 20 years and will target individuals earning no more than 30% of the Area Median Income (AMI).

TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS:

The County of Orange, in compliance with Title I of the Cranston-Gonzalez National Affordable Housing Act of 1990 has prepared a draft Consolidated Annual Performance and Evaluation Report (CAPER) for Fiscal Year 2022-23. The purpose of this notice is to provide the public a 15-day review period, beginning September 13, 2023, and ending September 27, 2023, to express their concerns and comments regarding the CAPER. The County of Orange is required to submit the FY 2022-23 CAPER to HUD by September 28, 2023.

Consolidated Annual Performance and Evaluation Report (CAPER)

The CAPER outlines the progress made in carrying out the proposed goals and objectives set forth in the FY 2022-23 Annual Action Plan. The CAPER also provides an analysis of program expenditures, project accomplishments, subrecipient’s performance and an assessment of what changes to policy or strategy may be in order.

The FY 2022-23 Annual Action Plan identified the Urban County of Orange’s overall needs and priorities for activities including Public Facilities and Improvements, Housing Rehabilitation, Public Services and Affordable Housing for low-income individuals and families.

Comments

All interested agencies, groups, or individuals are invited to review the draft CAPER for FY 2022-23 and submit written comments for consideration. REQUEST FOR RELEASE OF FUNDS

On or about August 21, 2023, County of Orange, Housing & Community Development will submit a request to the U.S. Department of Housing and Urban Development (HUD) Office of Community Planning and Development for the release of CDBG funds authorized under Title I of the Housing and Community Development Act of 1974, (24 CFR 570) as amended for the project known as Collette’s Children’s Home Placentia Hope Project for the purpose of renovating existing garages to construct (1) one-bedroom and (1) two-bedroom apartment additions over the existing garage space at 1038 Cypress Street, a building currently owned and maintained by Collette’s Children’s Home, estimated funding of $350,000.

FINDING OF NO SIGNIFICANT IMPACT

The County of Orange, Housing & Community Development has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review either electronically or by U.S mail. The County of Orange certifies to HUD that Julia Bidwell in her capacity as Director of OC Housing & Community Development, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County of Orange to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the County of Orange certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Orange; (b) the County of Orange has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
